In order to protect the interest of home buyers, the Ministry of Housing & Urban Affairs has enacted the Real Estate (Regulation and Development) Act, 2016 (RERA). As per Section 20 of the RERA, the ‘Appropriate Government’ i.e. the States/UTs are required to establish Real Estate Regulatory Authority to regulate and promote the real estate sector in the respective States/UTs.
As per the provisions of RERA, real estate projects and real estate agents are required to get registered with the Real Estate Regulatory Authority of the concerned State/UT before advertising, marketing, booking, selling in any manner. Real Estate Regulatory Authority is required to maintain a website, containing relevant details of all registered real estate projects and publish these details for public viewing.
For redressing the grievances/complaints/applications of home buyers, RERA provides for an Adjudicating Officer, Real Estate Regulatory Authority and Appellate Tribunal and provides a robust mechanism for the purpose. As on 30th June, 2019, total of 20,125 cases had been disposed off through the prescribed grievance redressal mechanism under the provisions of RERA. The top 10 States/UTs with respect to disposed off through the prescribed grievances redressal mechanism under the provisions of RERA as on 30-06-2019 were Uttar Pradesh, Maharashtra, Haryana, Madhya Pradesh, Karnataka, Odisha, Gujarat, Punjab, Tamil Nadu and Uttarakhand.
The number of grievances disposed off under provisions of RERA was 5,989 in Uttar Pradesh as on 30th June 2019, which accounted 29.76% of the total grievances disposed off under RERA in India. There were 5,028 grievances disposed off under provisions of RERA in Maharashtra as on 30-06-2019. It accounted 24.98% of the total grievances disposed off under RERA in India as on the same period. The number of grievances disposed off under provisions of RERA was 3,123 in Haryana as on 30th June 2019, which accounted 15.52% of the total grievances disposed off under RERA in India.
There were 1,959 and 1,230 grievances disposed off under provisions of RERA in Madhya Pradesh and Karnataka respectively as on 30-06-2019. Madhya Pradesh accounted for 9.73% and Karnataka accounted for 6.11% of the total grievances disposed off under RERA in India as on 30-06-2019.
As on 30th June 2019, the number of grievances disposed off under provisions of RERA in Odisha, Gujarat, Punjab, Tamil Nadu and Uttarakhand was 683, 651, 371, 295 and 265 respectively.
